Well ,if we observe the happenings in indian government since past one year, all we notice is corruption,scams may it be Adarsh society scam, or something very big like 2G spectrum scam.The only one who is at loss is the common citizen.His hard earned money is being wasted by someone corrupt person like anything.




Its time for some change in iNdian government , time to take some action against corruption.
And thats what is LOKPAL and LOKAYUKTA is all about.

So,lets start discussng whats its all about.




1. Who is ombdusman ?
--". An ombudsman is an official, who is  appointed by the government or by parliament.He/she is responsible for representing the interests of the general public by investigating on the complaints forwarded by the citizens of the nation.
Ombudsman is a govt official, so no costs involved.


2.What is LOKPAL and LOKYUKTA ?

The LokAyukta (also Lok Ayukta) is an anti-corruption ombudsman organization in the Indian states.These were the initiatives taken decades back to follow the very pattern of Scandinavian countries and parliamentary commissioner which is in New Zealand.

The 'ARC' which stands for Administrative Reforms Commission headed by Morarji Desai submitted a special interim report on "Problems of Redressal of Citizen's Grievances' in 1966. In this report, the ARC recommended the setting up of two special authorities designated as 'Lokpal'(At center level) and 'Lokayukta' (At State level) for listening to citizens' problems.

3.What is LOKPAL bill ?

The Jan Lokpal Bill  is a draft anti-corruption bill which was drawn up by prominent civil society activists which seeks to establish an independent body that will have the power to investigate the corruption cases and try to complete the cases within a year.
Its Drafted by Justice Santosh Hegde (former Supreme Court Judge and present Lokayukta of Karnataka),Prashant Bhushan (Supreme Court Lawyer) and Arvind Kejriwal (RTI activist).

Salient features of Jan Lokpal Bill:

1. An institution called LOKPAL at the centre and LOKAYUKTA at the state level will be set up .

2. No higher authorities will be able to influence the ongoing investigations,not even the ministers.

3. Investigations will have to be completed within the time bound of one year.So, it will facilitate faster decisions.

4. Its members will be selected by citizens, judges and constitutional authorities through a completely transparent process.No politicians will be involved.

5.The entire functioning of Lokpal/ Lokayukta will be completely transparent. If in case,Anyone complaints against any officer  of Lokpal,case will be investigated and the officer will be dismissed within two months.

6.CVC, departmental vigilance and anti-corruption branch of CBI will be merged into Lokpal. Lokpal will have all complete powers and machinery to investigate and prosecute any officer, judge or politician.

7.Lokpal will also provide protection to those who may be victimised for raising anti-corruption issues to the Lokpal.

BENEFITS TO COMMON CITIZEN :

1. If any work of any citizen gets delayed due to the negligence of any govt officer, that officer will be charged penalty and  that amount will be paid as compensation to the suffered citizen.

2.Any issues regarding passport,ration cards or police negligence can be reported to Lokpal.Lokpal will get that work done within one month.

WHATS THE BRIEF HISTORY OF ALL THIS ?


First mention of an Anti-corruption body- LOKPAL was made during early 1960s when Prime minister was JawaharLal Nehru. But it was in 1966 that a Lokpal was proposed at the Centre and Lokayuktas in states.
In 1968, a Lokpal Bill was presented for the first time in the fourth Lok Sabha. The House passed it in 1969. But while it was pending, LS was dissolved.
The Bill was revived various times in 1971, 1977, 1985, 1989, 1996, 1998 and 2001. But every time, it was referred to some committee of Parliament. The government has now prepared a rough draft of the Bill.
But after having a lot of scams,a fresh movement started by various activists. An alternative draft - Jan Lokpal Bill - was prepared by activists.Movement named India Against Corruption under the guidance of Karnataka Lokayukta Justice Santosh Hegde and senior lawyer Prashant Bhushan.Kiran Bedi(Retired IPS officer) and other known people like Swami Agnivesh, Sri Sri Ravi Shankar, Mallika Sarabhai and Anna hazare are also part of the movement, called India Against Corruption.

Anna Hazare, anti-corruption crusader, began a fast-unto-death , demanding that this bill, drafted by the civil society, be adopted.


WHATS THE LATEST SCENE ?

Govt agreed to the demands of Anna Hazare.
An agreement has been reached that the committee will have five Cabinet Ministers, with Finance Minister Pranab Mukherjee as chairman. Of the 5 members from civil society, one will be chosen to be the co-chairman.
From the government side, the 10-member joint drafting committee will have Mr. Mukherjee, Mr. Moily, Mr. Sibal, Home Minister P. Chidambaram and Mr. Khurshid.
Besides Mr. Hazare, civic society will be represented by the retired Supreme Court Judge, Justice Santosh Hedge; lawyer Prashant Bhushan, Mr. Kejriwal and the former Union Minister, Shanti Bhushan, who will also be co-chairman of the committee.
